One major revision allowed per item shown to the Client during the process.

After the cleaned sketch, only minor revisions are allowed.

Ongoing communication and discussion will occur throughout the project, including work in progress, idea generation and collaboration, situational updates, and more.

Communication channels may include discord (artsy_len), VGEN messages or e-mail ( [email protected] ) according to Artist discretion and the clients preferences.

Artist response time may vary, up to one week in order to provide better or more concrete updates.

Smaller commissions (such as chibi icons) do not require work in progress updates unless there are things in the design that are unclear.

The Artist retains copyright, ownership, redistribution and intellectual property rights, which includes but is not limited to display, advertising, printing, the Work and work in progress on websites, social media, portfolios, public broadcast channels (i.e. Twitch) and more.

Clients receive exclusive, non-transferable usage rights to the Work for personal use. Refer to Section 6.c. for commercial rights.

Personal use means: display on social media accounts for promotional purposes with no direct monetization such as profile pictures, banners, and posts; print and framing in personal spaces; display as part of designs on websites and channels, excluding use in content of these websites or channels.

Client must not claim Work as their own and must credit Artist using their social tag/username/link at the instance of display of the Work or permanently on their websites, social media profiles, broadcast channels and so on.

Client must not edit or modify Work in any way without prior permission from the Artist.

Commercial usage rights are not included unless specified in the commission type or listing on the Artist’s websites (i.e. vtuber models, stream overlays, emotes, and so forth) or as agreed upon.

Commercial rights means usage of Work on streams or any monetized instances, or selling or reselling Work to another party, as a part of any product, or on another platform.

Usage of Work for AI (artificial intelligence) tools; platforms or programs, ML (machine learning) tools, platforms or programs; AI or ML training; NFT; blockchain; or other for-profit platforms/purposes, is strictly prohibited.

Additional charges will be required for commercial usage if not included, typically 2x of the original cost.

Client pays either up-front or half before the start of the project. (Ko-fi requires upfront payment)

Invoices, proposal or payment link will be sent to the Client when Artist is ready to begin work. Clients must not send money before these requests for payment from the Artist.

Invoices must be paid within 2 days, or the project may be cancelled.

Prices are in USD or EUR, and paid via Stripe, PayPal, or methods as provided by the Artist.

Prices may vary or change depending on complexity, requirements and/or additional requests.

Once Work has begun or payments have been made, the Client acknowledges Work and deliverables are digital and there are no physically shipped goods to receive.

Client warrants they will not issue chargebacks and the refund policy mentioned below will be followed.

If Client requests cancellation, 50% of project fees may be forfeit if the artist has already started the commission. A refund may be provided if the commission hasn't started or is in a beginning stage.

No refunds are possible after work begins unless initiated by the Artist or agreed upon between artist and client.

If Artist cannot complete work or there are delays as detailed in Section 3 for unforeseen reasons, the Client may be eligible for a full refund. If work done up to this point is accepted and used by the Client, the Artist will provide a partial refund only.

The Artist and Client acknowledges that information and materials that are provided to either party (including but not limited to personal information, technical information, marketing plans, payment information, or sensitive business information), or are incorporated into the deliverables, that will not be visible to the public shall be considered confidential information and shall not be disclosed to any other party without prior written permission from the owner of this confidential information.

Client indemnifies Artist against claims, losses, damages, and expenses related to Work usage by the Client, breach by the Client of the Agreement, or third-party claims.

If Client's rights are violated or the Work is not delivered as agreed, Artist will work to remedy the situation first.

Client is 18+ and legally able to commit to an agreement or has a legal guardian to make this agreement on their behalf.

Agreement date is upon first inquiry/communication or first transaction.

You may NOT profit off of the illustration by using it for prints, logos or any other commercial purposes.

You may NOT claim the design or artwork as your own.

You may NOT alter the illustration or use AI to make alterations. However you may place the transparent illustration (example chibi full body) onto your reference sheet as long as my credit is displayed somewhere.

You may NOT duplicate/edit the art with intent to sell the results as your own or as part of your own product.

You may share the illustration online (Toyhouse, etc.) as long as you credit me for the illustration

You may alter the character's design upon purchase however you desire.

you are not eligible for a refund once you have purchased the character, as you have gained access to the files without watermarks. You may resell [read 4. Resale] the character.

You may gift, resell or trade the adoptable after purchase.

Resale value cannot be higher than purchase price.

Resale value can be increased through additional commissioned art. [ Read 4.e ]

Raffles/Giveaways: In the case of winning one of my adopts, you may not sell the character unless you added additional value through additional art and commissions. In this case, I have to be informed and I will have to approve the resale price. [ Read 4.e ]

Adding additional value to adopts using personal art made YOURSELF is allowed only if you ask for my permission. In that case, I will be required to approve the new resale price and deem if it is reasonable. Inflating resale price by free requests or Artfight attacks is NOT allowed.

You may use your character for commercial uses like prints, streaming, etc as long as it is commissioned or self drawn work. [ read 1.a ]

You may use this character for any personal use like art, campaigns, story building etc.

You are not allowed to use my designs / illustrations for the training of generative AI.

You are not allowed to sell this character as an NFT or for any crypto currency.

you are responsible for safekeeping any bought digital assets. You may request me to send you a digital copy of sold media, but I have no requirement to do so.

If you lose any digital assets bought by me you are NOT eligible for a refund.

All products are the original creations of the Artist and are protected by copyright law.

Purchasing a product does not transfer ownership or copyright.

The Artist retains full intellectual property rights, including the right to display, promote, and distribute the work for marketing or portfolio purposes.

The Customer receives a license to use the product according to the terms of the license purchased ( see Section 2 ).

Use the asset in your own personal projects or content.

Display it on personal social media and channels.

Make minor personal edits (e.g., resizing, cropping, adding text).

Use the asset for commercial purposes, branding, streaming or merchandise.

Redistribute, resell, share, or include the asset in free or paid asset packs.

Claim the work as your own.

The Artist retains copyright and authorship.

You may not resell, redistribute, or sublicense the asset.

You must provide credit to the Artist (e.g., “Asset by artsy_len”) where reasonably possible.

If a commercial license is not explicitly offered, the asset may only be used for personal use. Should you purchase an item with personal use and would like to request commercial use at a later time, an additional license can be purchased once discussed with the artist.

Use my assets for AI generation, dataset training, or machine learning models.

Resell, redistribute, or include my work in asset packs or templates.

Use my work for NFTs, crypto projects, or blockchain media.

Claim authorship or remove any identifying watermarks or signatures.

Use my assets in hateful, discriminatory, or illegal content.

All payments are processed through VGEN’s checkout system.

Because all items are digital, no physical shipment will occur.

Files are delivered automatically or via download link upon completion of payment.

Ensure you have the appropriate software or tools to use the digital files.

All sales of digital products are final.

Refunds, returns, or exchanges are not available.

The Artist is not liable for any damages, losses, or technical issues arising from the use or misuse of purchased assets.

The Customer is responsible for ensuring compatibility with their software or streaming platform.

These Terms may be updated or amended periodically. Continued purchases or use of products after updates constitutes acceptance of the revised Terms.
